SnapUp Content Submission Terms & Conditions

SnapUp allows event attendees, visitors, customers, participants, guests, or other contributors to submit digital content directly through an upload page or QR code.

Your submitted content may be reviewed by the Organizer and may be displayed on an event screen, social wall, digital signage, website, application, or other destination configured by the Organizer.

“Content” means any material you submit through SnapUp, including:

• photographs
• images
• photographs
• videos
• GIFs
• captions
• text
• comments
• other files or materials supported by the SnapUp submission interface.

You retain ownership of the Content that you submit, subject to any rights belonging to third parties.

Submitting Content through SnapUp does not by itself transfer ownership of your Content to Social Walls or the Organizer.

You should not submit Content unless you have the rights and permissions necessary to do so.

By submitting Content, you confirm that:

• You own the Content or have sufficient rights and permissions to submit it.
• Your submission does not knowingly infringe another person's copyright, trademark, privacy, publicity, or other legal rights.
• Where required by law, you have permission from identifiable individuals appearing in the Content.
• You have permission to submit any third-party photographs, videos, artwork, music, trademarks, logos, or other protected materials contained in your submission.
• Your submission does not knowingly violate applicable law.
• Your submission does not contain malware, malicious code, or other harmful material.

By submitting Content, you grant Social Walls and the Organizer a non-exclusive, worldwide, royalty-free permission to use your Content to the extent reasonably necessary to:

• receive your submission
• host and store your submission
• process and technically format your submission
• moderate or review your submission
• create thumbnails or previews
• display your submission through the SnapUp experience
• transmit your submission to the Organizer's configured display or destination; and
• operate, maintain, secure, and provide the SnapUp service.

The Organizer may choose whether or not to publish your submission.

Submitting Content does not guarantee that it will be displayed.

The Organizer may reject, hide, remove, or decline to publish your Content.

If displayed, your Content may be visible to event attendees, website visitors, social wall viewers, digital-signage audiences, or other members of the public depending on how the Organizer has configured its SnapUp experience.

You should therefore only submit Content that you are comfortable being displayed in the relevant environment.

The Organizer may request additional permission to use your Content for purposes beyond operating the SnapUp experience.

• social-media publication;
• advertising;
• marketing campaigns;
• promotional materials;
• websites;
• digital advertising;
• printed materials;
• event promotion;
• brand communications; or
• other commercial or promotional activities.

Where additional permission is requested through a separate checkbox, notice, release, or Customer-specific terms, you should review that request before accepting it.

Your acceptance of any additional permission will apply according to the specific terms presented to you.

Your agreement to these SnapUp Terms is intended to permit the processing and use of your submission necessary to operate the SnapUp experience.

It does not automatically mean that you agree to receive unrelated marketing communications from Social Walls or the Organizer.

Where separate consent is required for marketing communications or additional uses of your personal information or Content, that consent should be requested separately.

Depending on how the Organizer has configured SnapUp, you may be asked to provide information such as:

• name or nickname;
• email address;
• location;
• event-related information;
• other information voluntarily provided with your submission.

The specific information collected and the purposes for which it is used should be explained in the privacy notice presented with the relevant SnapUp experience.

You should not provide sensitive personal information unless specifically requested and you are authorized to provide it.

Your personal information may be processed by Social Walls as part of providing the SnapUp service and by the Organizer for the purposes for which the Organizer collected it.

The applicable Privacy Policy and any Organizer-specific privacy notice provide additional information about:

• what information is collected;
• why it is collected;
• how it is used;
• who may receive it;
• how long it may be retained;
• how you may exercise applicable privacy rights; and
• how you may withdraw consent where consent is the applicable legal basis.

Where applicable, Social Walls and the Organizer will process personal information in accordance with applicable data-protection laws.

Where your personal information is processed on the basis of your consent, you may withdraw that consent using the method provided in the applicable privacy notice or by contacting the relevant party.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Where applicable law requires cessation of processing following withdrawal, the relevant party will take appropriate steps subject to any legal exceptions or other lawful grounds for continued processing.

You may request removal of Content that you submitted through SnapUp.

Please provide enough information to identify the relevant submission.

We may require reasonable information to verify your request.

Removing Content from a SnapUp display does not necessarily mean that copies held in backups, security systems, legal records, or other systems will immediately be deleted.

The Organizer and/or Social Walls may review submitted Content.

Content may be rejected, removed, hidden, or restricted if it:

• violates these Terms;
• violates applicable law;
• infringes third-party rights;
• contains unlawful or harmful material;
• contains malicious code;
• contains abusive, threatening, hateful, or harassing material;
• contains inappropriate or sexually explicit material where prohibited;
• exploits or endangers children;
• contains fraudulent or misleading material;
• contains unauthorized advertising or promotional material; or
• creates a security, legal, operational, or reputational risk.

We do not guarantee that your Content will:

• be accepted;
• be published;
• be displayed;
• remain displayed;
• appear in a particular position;
• remain available for a particular period; or
• be used by the Organizer for any particular purpose.

The Organizer may make independent decisions regarding the publication and use of submitted Content.

To operate SnapUp, your Content may be technically processed.

This may include:

• resizing;
• cropping;
• compression;
• transcoding;
• thumbnail creation;
• formatting;
• security scanning;
• moderation processing; and
• other technical processing necessary to provide the service.

Such technical processing does not transfer ownership of your Content.

If your submission includes another person's image, voice, name, artwork, music, trademark, or other protected material, you are responsible for obtaining any permissions required by law.

You should not submit content containing another person where you do not have the necessary permission or lawful basis.

SnapUp should not be used by a minor where applicable law requires parental or guardian consent unless the required consent has been obtained.

If you submit Content containing a minor, you confirm that you have obtained any permission required by applicable law from the parent or legal guardian.

If you believe Content involving a minor has been submitted or displayed without appropriate permission, contact the Organizer or Social Walls promptly.

You must not submit Content that:

• infringes intellectual-property rights;
• violates another person's privacy or publicity rights;
• is unlawful;
• is fraudulent or deceptive;
• impersonates another person;
• contains malicious software;
• promotes illegal activity;
• contains unlawful threats;
• unlawfully harasses another person;
• exploits children;
• contains prohibited sexual content;
• promotes unlawful discrimination or violence; or
• otherwise violates applicable law.

Unless the Organizer expressly agrees otherwise in writing or through a separate offer, you will not receive payment or other compensation merely because your Content is submitted, displayed, or processed through SnapUp.

Any additional commercial-use permission requested by the Organizer will be governed by the terms presented with that request.

SnapUp is technology provided by SocialWalls.

The Organizer determines how its SnapUp experience is configured, including, where available:

• what Content it requests;
• what information it collects;
• whether submissions require moderation;
• what Content is displayed;
• where Content is displayed; and
• whether additional permissions are requested.

Accordingly, questions concerning an Organizer's specific campaign, event, use of submitted Content, or additional permissions should generally be directed to the Organizer.

SnapUp is provided on an “as available” basis.

To the maximum extent permitted by applicable law, Social Walls does not guarantee that:

• SnapUp will always be available;
• every submission will be successfully uploaded;
• every submission will be displayed;
• submitted Content will remain available;
• the Organizer will use Content in a particular manner; or
• the service will be uninterrupted or error-free.

We may update these Terms from time to time.

The current version will be made available through the relevant SnapUp submission page or Social Walls website.

Where required by applicable law, material changes will be communicated or presented for acceptance in an appropriate manner.

These Terms are subject to applicable law.

Nothing in these Terms limits any mandatory rights or protections that you may have under the laws applicable to you.

By submitting Content through SnapUp, you confirm that you have read and agree to these SnapUp Content Submission Terms & Conditions and that you have the necessary rights and permissions to submit the Content.
